Branch Office

A legal extension of your existing company, not a new entity. Registered with SUNARP under Peru's General Corporations Law, with a locally appointed legal representative holding sufficient powers to act on the parent company's behalf.

Faster to stand up since it leans on your parent company's existing standing — but profits, liabilities and obligations flow back to the parent.

Filial

Subsidiary (S.A.C.)

A separate Peruvian legal entity, typically wholly or majority owned by your company. The standard vehicle for a fully foreign-owned local operation, with its own RUC, its own contracts and its own liability, ring-fenced from the parent.

Takes a little longer to set up than a branch, but gives you the cleanest base to build a standalone operation — or a template to replicate in the next LATAM country.

Common questions

Do I need my own Peruvian entity before I can start operating?

No. Through EVANG's brand representation model, we become the legal employer for your local team and operate under your brand from day one. This matters because office licensing in Peru typically requires proof of formal employment contracts and social benefits — something a brand-new entity can't produce immediately. The minimum term is 12 months; once your own entity is ready, we help transition your team onto your payroll.

Should we open a branch or a subsidiary in Peru?

A branch (sucursal) is a legal extension of your existing company — faster to set up, but profits and liabilities flow back to the parent. A subsidiary (S.A.C.) is a separate Peruvian entity with its own liability, and doubles as a template if you plan to replicate the setup in other LATAM countries. Most companies decide this in the first scoping conversation, based on tax structure and expansion plans.

Can a foreign company or individual own 100% of a business in Peru?

Yes. Under Peru's foreign investment framework (Legislative Decrees 662 and 757), foreign investors receive the same treatment as local investors, and Peruvian equity participation is not required in most sectors. Full foreign ownership is standard for a S.A.C., the entity type most foreign companies use.

Do I need a local legal representative or a physical presence to incorporate?

You need a legal representative in Peru to sign incorporation documents and interact with SUNARP and SUNAT, but you don't need to relocate. EVANG handles the incorporation process and provides a registered office from day one.

Can EVANG provide office space and run day-to-day operations for us?

Yes — that's EVANG's core business, run today for over 500 clients across Peru. We sublease office space, coordinate accounting and electronic invoicing on our own FacturaCrece platform, manage payroll support, and, if needed, run our own sales force and trade marketing teams for commercial execution.

Does Peru's trade network help me reach the rest of Latin America?

Peru is a CPTPP member, a founding member of the Pacific Alliance, an associate member of Mercosur, and holds FTAs with China (upgraded 2024–2026) and Hong Kong (signed 2024) — plus Puerto Chancay, a direct maritime link to Asia. One of the most trade-connected positions in the region.

Is the service package fixed, or can it be adapted to what we need?
